The CFPB Issues Corrected Background Check Forms

The Consumer Financial Protection Bureau (CFPB) has issued corrected versions of its model forms “Notice to Users of Consumer Reports: Obligations of Users Under the FCRA” and “Summary of Your Rights Under the Fair Credit Reporting Act.” The CFPB has acknowledged that the model forms they published in December 2011 contained typographical and other technical errors.

The “Summary of Your Rights” is a form which employers provide to applicants/employees as part of the background check process. The deadline for employers to replace the old FTC published forms with forms based on the CFPB form is January 1, 2013. Your background check company should provide you with a copy of this form.

The “Notice to Users of Consumer Reports” is a form which outlines employer responsibilities under the FCRA when conducting employment background checks. Employers should review this form regularly to ensure they are compliant with the FCRA. Your background check company should provide you with a copy of this form.
